USCIS UPDATE: INCOMPLETE FILINGS MAY BE DENIED WITHOUT AN RFE

USCIS has updated its policy on evidence, Requests for Evidence (RFEs), and Notices of Intent to Deny (NOIDs). The new guidance is effective immediately.
Key Points to Note:
- Incomplete filings may be denied: USCIS officers may deny certain applications or petitions that lack required initial evidence without first issuing an RFE or NOID.
- Submit complete evidence upfront: Applicants and petitioners should ensure all required initial evidence is included at the time of filing.
- RFE response periods may be shorter: USCIS is no longer generally required to provide the maximum 12-week response period.
- International mailing rule changed: The previous additional 14 days for notices mailed outside the U.S. has been eliminated.
- The updated guidance applies to benefit requests pending or filed on or after August 5, 2026.
What This Means for You:
Do not assume USCIS will give you an opportunity to fix an incomplete filing later. A complete and well-documented application from the outset is now more important than ever.
